ANEEL is planning to open a public consultation to adapt energy tariffs to the arrival of the CBS in 2027, focusing on utilizing tax credits and protecting consumers.
The Brazilian Electricity Regulatory Agency is preparing an essential regulatory discussion for the clean and sustainable energy sector, targeting the impact of the tax reform on electricity bills.
The core issue involves replacing old taxes with the CBS starting in January 2027, requiring distribution and transmission utilities to adjust their billing models.
The measure aims to prevent financial overlaps and ensure that tax benefits reach final consumers directly.
With a tight debate schedule planned, the board is evaluating how to handle the backlog of tax credits without destabilizing the economic planning of companies regulated by the federal agency.
Credit Management and Impact on Bills
The technical team’s primary concern lies in managing the remaining balances of PIS/Pasep and Cofins accumulated through the end of 2026.
The legislation allows companies to continue appropriating certain credits related to asset depreciation, but regulation must prevent this value from being charged twice in the tariff.
To resolve the impasse, the plan suggests creating a negative financial component in the tariff processes of electric utilities.
Thus, tax recovery projections will be temporarily deducted, with subsequent reconciliation against actual fiscal data presented by electric sector companies.
The regulation must shield consumers against duplicate charges, ensuring that the tax utilization is reverted into tariff moderation during the transition of the new consumption model.
Maintenance of the Regulatory Base and Next Steps
In this initial stage, the calculation methodology for the Regulatory Asset Base will be preserved to avoid immediate legal instabilities.
Deeper changes in the valuation of capital assets will be left for future discussions within the Regulatory Agenda, requiring complex mapping of the companies’ inventory.
Furthermore, so-called ancillary revenues will undergo adaptations to maintain financial neutrality and continue benefiting tariff moderation.
The advancement of these guidelines depends on the final deliberation of the collegiate board after the closing of the market agents’ contribution period.
