The MME is considering requiring Suzano to present a financial guarantee for the Celpav IV thermoelectric plant, winner of a capacity auction.

The Brazilian electricity sector is debating new requirements for projects that sold power in recent auctions. The Ministry of Mines and Energy is studying mandatory collateral for Suzano‘s plant.

The discussion involves the 18.53 MW UTE Celpav IV thermal power plant, which was successful in the auction held in March this year. The project was initially qualified without any requirement for financial contributions.

Shift in Understanding Regarding Investments

During the registration phase, the project was classified as an existing plant. The strategy consisted of reusing machinery that previously operated at UTE Jacareí I.

As a result, the responsible committee accepted the declaration of zero operational costs. However, new documents submitted to the government revealed a schedule requiring physical interventions.

The ministry identified that there will be financial expenditures for the installation of the equipment. This finding prompted a formal request for an opinion from Aneel.

Regulatory Position

In response to government inquiries, the regulatory agency indicated that requiring collateral is applicable. However, the measure depends on the exact quantification of the costs projected by the company.

The federal agency noted that requiring collateral is feasible as long as the company details the estimated project costs.

The auction rules allow for differentiated deadlines in specific situations. There is an option for an extension of up to two months to deliver financial security.

This administrative flexibility does not alter the official supply schedule. Commercial operation remains set for 2027, ensuring support for the energy transition and the power grid.
