Brazilian Federal Audit Court Postpones Petrobras Pricing Policy Review

The Brazilian Federal Audit Court (TCU) has postponed its review of Petrobras’s pricing policy. Minister Odair Cunha’s request for further review puts the monitoring of the state-owned company on hold for 30 days.

The Brazilian Federal Audit Court (TCU)‘s monitoring of Petrobras’s fuel commercialization strategy underwent a strategic pause this Wednesday (September 23, 2026). Minister Odair Cunha requested a 30-day hold on the process, citing the need to examine a related case under his purview, thereby ensuring a more in-depth analysis of the regulatory impacts.

The judgment, which was set to take place in an extraordinary and restricted session due to the confidential nature of the commercial data, focused on evaluating the governance of the oil company’s Diesel and Gasoline Commercial Strategy. The TCU’s primary objective is to verify whether the state-owned company’s internal decision-making mechanisms align with the company’s economic sustainability and with the transparency principles required for a mixed-capital company.

A Paradigm Shift in Fuel Prices

Since May 2023, Petrobras’s pricing landscape has undergone a significant transformation with the abandonment of the PPI (Import Parity Price). The previous policy, which directly linked prices charged in Brazil to international market fluctuations, was replaced by guidelines that grant the company greater autonomy to manage its operational costs in light of Brent crude oil barrel volatility.

The termination of the direct link to the PPI was one of the central promises of President Luiz Inácio Lula da Silva’s government, aiming to offer greater predictability to domestic consumers and protect the internal market from abrupt shocks.

Continued Oversight and Governance

The Federal Audit Court’s involvement is not new. The TCU has closely monitored the transition in pricing policy to ensure that the flexibility gained by the state-owned company does not compromise its financial health. In November 2024, the court mandated the company to formalize rigorous internal rules detailing how readjustment decisions should be made, establishing a semiannual monitoring process slated to last two years.

This postponement reflects the complexity of the court’s task, which seeks to balance government policy directives with the preservation of Petrobras’s institutional interests. The market and investors remain attentive to developments, as the TCU’s verdict is crucial for guiding confidence in the corporate governance of the country’s largest company in the coming years.
