ANEEL Maintains Consortium ION’s Disqualification in Capacity Reserve Auction

The ANEEL maintained the disqualification of Consórcio ION from the Capacity Reserve Auction in the form of Power, highlighting the importance of rigorous financial requirements for the security and stability of the electric sector.

The National Electric Energy Agency (ANEEL) reaffirmed its decision to disqualify Consórcio ION, led by EPP, from the Capacity Reserve Auction in the form of Power (LRCAP). The measure, announced by the Permanent Auction Commission (CPL) this Wednesday (2nd), emphasizes the seriousness with which the regulatory agency evaluates the financial health of participants in auctions crucial for the country’s energy supply.

The core of the decision lies in the group’s non-compliance with the economic-financial requirements stipulated in the tender notice. This requirement is fundamental to ensure that contracted agents possess the necessary robustness to honor long-term commitments in a sector as vital as clean and sustainable energy.

Detailed Accounting Reassessment

The disqualification of Consórcio ION is the result of a thorough review of the net worth declared by its member companies. ANEEL‘s CPL recalculated the values, making deductions for accounting assets that did not meet the criteria for demonstrating financial capacity.

Credits and accounts receivable, as well as instances of duplicate accounting among companies within the same corporate group, were identified and expunged.

With the adjustments applied by the technical analysis, it was found that five of the consortium’s companies had negative net worth. This scenario made it impossible to meet the financial conditions established for participation in the auction.

The CPL highlighted that the originally declared values were already close to the minimum limit set by the tender notice, making the deductions sufficient to disqualify the group.

The Importance of Financial Solidity

The rigor of the economic-financial criteria in a capacity reserve auction is not mere formalism. It aims to ensure that future contractors have the full capacity to sustain the investments and operations associated with power contracts.

The guarantee of security in the energy supply and availability for the National Interconnected System (SIN) directly depend on this solidity.

In a complementary analysis, ANEEL‘s technical department simulated an alternative scenario, even considering the validation of some accounts receivable. The conclusion was that, even with this flexibility, three consortium companies would remain disqualified, reinforcing that the decision was not based exclusively on the disregard of receivables.

According to the tender rules, the disqualification of any individual member of the consortium implies the disqualification of the group as a whole.

A commission representative stated:

Financial solidity is the backbone of any long-term contract in the electric sector, especially in an auction aimed at ensuring supply security for the country.

Next Steps in the Auction

It is important to emphasize that the commission found no formal irregularities in the submitted accounting statements, such as errors in bookkeeping or documentary fraud. ANEEL‘s decision is intrinsically linked to the insufficiency of eligible financial indicators after the technical analysis, and not to any type of falsification.

With the technical understanding maintained, the disqualification of Consórcio ION will proceed to final approval by ANEEL‘s collegiate board. This step is crucial to consolidate the list of agents effectively qualified to bid for the power contracts of the LRCAP.

This auction is a fundamental part of the national strategy to strengthen energy security and power availability, vital aspects for development and the transition to clean energy sources in Brazil.
