The National Petroleum Agency (ANP) has issued a new resolution adjusting the calculation and payment of royalties to municipalities, aiming to eliminate double counting and bring greater clarity to the energy sector.

The ANP (National Agency of Petroleum, Natural Gas and Biofuels) has formalized Resolution No. 1.007/2026, marking a significant shift in the management of financial compensation for cities impacted by hydrocarbon logistics. The new text replaces the former Technical Ordinance No. 29/2001, modernizing distribution criteria to align the sector with the guidelines established by Decree No. 12.849/2026.

Retroactive to July 2026, the regulation establishes that marine terminals directly connected to offshore facilities are now officially recognized for compensation calculations. The agency’s primary goal is to put an end to long-standing legal disputes over exactly where oil and gas measurements should be taken for the transfer of municipal funds.

Legal Certainty and Ending Double Counting

One of the most relevant aspects of the new resolution is the implementation of a rigorous control system to prevent bis in idem—or the double counting of production volumes. From now on, the volume of oil and gas processed cannot be accounted for simultaneously at both a marine terminal and its corresponding offshore facility.

This operational safeguard ensures that transfers are based on precise technical data, promoting necessary fiscal balance. The measure provides greater financial predictability for both local governments and federal planning by consolidating monitoring parameters for the outflow of strategic fields.
