The Pampa Sul power plant has turned to Aneel to freeze millions in charges resulting from transmission failures following severe storms in Rio Grande do Sul.
Power generator Pampa Sul has formally requested an emergency injunction from Aneel to halt the financial impacts resulting from the shutdown of its operations.
The issue began after severe storms battered Rio Grande do Sul, damaging transmission grids and preventing the injection of electricity into the national interconnected system.
In the document submitted to the regulatory agency, the company points to potential losses exceeding 20 million reais.
The generator emphasizes that its physical facilities maintained full technical capacity, but were unable to operate due to external failures in the power transmission infrastructure.
Impacts on the short-term market
The largest share of the losses estimated by the company is concentrated in the MCP, totaling approximately 17 million reais in projected losses across the affected months.
The discrepancy between assumed contractual commitments and actual delivery has generated a severe imbalance in the company’s accounts.
In addition to spot market exposure, the generator is also questioning the application of grid usage charges during the period of forced inactivity.
The company argues that it should not be financially penalized for an obstacle beyond its control, which was even acknowledged by official sector authorities.
The company emphasizes that its facilities were ready and able to operate, but power dispatch was blocked by grid restrictions that are entirely beyond our operational control.
Guarantees and the future of supply
The urgency of the administrative appeal is tied to the electric sector’s strict financial settlement deadlines, which could severely jeopardize the company’s cash flow and its relationship with creditors.
The requested suspension aims to shield the enterprise against sanctions and default while the damaged infrastructure undergoes permanent repairs.
With the full normalization of transmission lines operated by Chimarrão Transmissora expected soon, the sector awaits the complete restoration of normalcy.
Aneel‘s decision will serve as a barometer for the legal security of generators affected by severe weather events in the country.
