The tax reform transition will bring a momentary impact on electricity bills starting in 2027, requiring regulatory adjustments to prevent harm to both clean and traditional energy consumers.

The implementation of the tax reform in Brazil could lead to a temporary surge in electricity tariffs right at the beginning of 2027. This warning was issued by the technical team at Aneel during a strategic session focused on discussing the electric sector‘s adaptations to the country’s new fiscal rules.

With the extinction of PIS/Pasep and Cofins, replaced by CBS, the billing dynamics will undergo a complete upheaval. The current model embeds taxes in the generation and transmission stages, but the new legislation will concentrate tax collection directly at the final point of consumption, requiring rigorous planning from energy companies.

The Contract Maze and Cost Overlap

The main technical challenge lies in the interval between the legal change and its practical application in annual adjustments. Existing contracts will continue to carry the old taxes until they undergo the next regulatory review cycle for each energy distributor.

While old costs are still factored into past invoices, the new consumption tax rate will start to apply simultaneously. This temporary overlap explains the projected jump in amounts charged to citizens before compensatory mechanisms begin to take practical effect.

The complexity of this transition demands meticulous alignment so that the fiscal burden does not fall definitively on the end consumer during the period of norm adaptation.

To mitigate distortions, the CVA (Vulnerability Cost Adjustment) will act as an adjustment tool, recording the difference between expected expenses and the actual disbursements of concessionaires. In this way, financial relief resulting from the removal of old taxes will be returned to society in the tariff adjustments scheduled for 2027 and 2028.

Next Steps and the Future of the Energy Market

The board of Aneel has given the green light for public consultations with tight deadlines, aiming to finalize the new regulatory framework before the deadline. The joint effort seeks to settle issues regarding remaining tax credits and the adaptation of commercial agreements in the regulated market.

The outcome of these discussions will shape the financial stability of the clean and conventional energy sector in the coming years. Ensuring transparency in this fiscal transition will be crucial for maintaining investor confidence and protecting the budgets of Brazilian families.
