The federal government and Aneel are joining forces to structure the future of power distribution in São Paulo, responding to pressure from the Federal Court of Accounts.

The Ministry of Mines and Energy (MME) and the National Electric Energy Agency (Aneel) have initiated a strategic coordination to determine the future of the electricity concession in the capital of São Paulo and its metropolitan area.

This move comes amidst intense political and operational pressure regarding the quality of services provided by Enel São Paulo, whose current contract expires in June 2028.

The joint effort between federal authorities follows a strict determination by the Federal Court of Accounts (TCU).

The court has set a November 27 deadline for the agencies to present a detailed technical timeline, ensuring the continuity and stability of energy supply for millions of consumers after the current contract ends.

Institutional progress and defined deadlines

To meet the TCU‘s requirements, the Ministry has formally requested that the regulatory agency promptly appoint a technical representative.

This focal point will coordinate joint negotiations, structuring in-depth analyses of the service model that will take effect when the contract expires.

Despite the urgency imposed by the schedule, the MME emphasized that this joint planning does not imply any preemptive decision regarding the current status of the concessionaire.

Simultaneously, the regulatory agency’s board has debated the possibility of recommending the forfeiture of the contract, although the process was momentarily paused following a request for a review of the case.

The debate on contract forfeiture and the future of the concession

During regulatory discussions, the concessionaire’s stance drew criticism from the Aneel board.

Sector authorities point out that the distributor has adopted administrative questioning strategies that increase institutional tension, while the agency reinforces the rigor of its oversight in the face of recurring power supply failures.

With the ruling on the contract forfeiture postponed, the outlook for the clean energy sector and São Paulo’s electrical infrastructure remains under heavy scrutiny.

Authorities are evaluating three main paths for the post-2028 period: renewal with the current operator, a change in the company’s ownership, or opening a new public tender to attract operators committed to energy transition and grid modernization.
