The Chamber of Deputies approved the bill allocating 75% of oil royalties to education and 25% to public health in Brazil.

In response to intense social mobilizations that swept the country, the Chamber of Deputies took a decisive step to increase state investments in vital services.

The approved proposal restructures the distribution of funds generated by the fossil fuel energy sector and channels these resources primarily to public education and the health system.

The measure addresses a priority demand of President Dilma Rousseff‘s administration, seeking to accelerate the social return from the exploitation of natural resources.

Strategic Division of Oil Resources

The text approved, drafted by rapporteur André Figueiredo (PDT-CE), established that 75% of royalty revenues would be directed to basic education, while 25% would go to public medical services.

The new rule applies to ongoing ventures, provided that the commercial extraction stage began after the end of 2012, covering concession, onerous assignment, and production sharing contracts.

With this expanded scope for exploration agreements, official estimates project total investments to jump from R$ 25.8 billion to R$ 335.8 billion over a ten-year period.

With the substitute, we will be able to better value teachers with resources in the short and medium term, without having to wait ten years to use the pre-salt oil money.

Social Fund Contribution and Plenary Disagreements

In addition to direct contract revenues, the measure mandates the direct application of half of all resources allocated to the Social Fund from the deepwater exploration sector into education.

This allocation will remain valid until the country achieves the goals set in the National Education Plan (PNE), which foresees the application of 10% of the national Gross Domestic Product in public education.

Congressman Ronaldo Caiado (DEM-GO), author of the amendment that secured funds for the medical area, highlighted the balance achieved in negotiations during the bill’s review.

We did not make an indefinite transfer of the Social Fund to these areas and we recovered this House’s commitment to serve education and also health.

On the other hand, government leader Arlindo Chinaglia (PT-SP) expressed concern regarding the text’s legal security, warning about possible unconstitutionality challenges and impacts on the fund’s sustainability.

Prospects and Congressional Proceedings

The allocation of fossil fuel revenues demonstrates a strategic transition movement, aiming to convert finite energy assets into long-term human development and sustainable infrastructure.

To facilitate consensus and ensure the vote in the final plenary session, the rapporteur agreed to remove clauses involving revenues from direct services provided by Petrobras in well research and extraction.

After approval in the lower house, the bill moves to the Federal Senate for final review and deliberation before it can take effect.
