Court Rules in Favor of Tradener: Credits Unblocked at CCEE After Judicial Reorganization

The Paraná State Court has issued a favorable ruling for energy trading company Tradener, ordering the Electric Energy Commercialization Chamber (CCEE) to release funds withheld in settlements occurring after May 22. This date marks the start of the company’s judicial reorganization process, a legal milestone that, according to the decision, prevents further withholding of credits.

The court order, though positive for the company, does not reverse the blocking of funds prior to that date. These funds, particularly those related to the March accounting, remain in dispute and are central to disagreements regarding adjustments made to Tradener‘s contracts at CCEE.

This week’s ruling by the Paraná State Court of Appeals (TJPR) is a crucial step in resolving the dispute. A previous decision in April had authorized Tradener to modify the energy delivery profile in its contracts, based on its suppliers’ load curves. However, the subsequent suspension of that authorization triggered the controversy over the records and, consequently, the freezing of credits.

Appeals Judge Marcelo Gobbo Dalla Dea based the recent decision on the argument that the judicial reorganization law protects the company’s assets after the process is approved. He emphasized that the continued withholding of funds, without a defined deadline, constituted an undue seizure and could harm Tradener‘s current operations.

The decision to unblock funds starting from May 22 highlights the application of the Judicial Reorganization and Bankruptcy Law, which aims to safeguard the assets of a company undergoing restructuring. The released funds will remain under the supervision of the judicial reorganization court.

On the other hand, funds withheld before the formal commencement of judicial reorganization remain under scrutiny. The controversy surrounding the change in a credit balance from R$ 3.66 million to R$ 28.35 million after adjustments at CCEE will still be analyzed, as will the inclusion of energy purchase contracts in the adjustments made by the company.

The legal dispute began in April when Tradener obtained an injunction to adjust its energy delivery profile, aiming to align its commitments with the energy received from its suppliers. The measure was suspended after appeals from creditors, who argued that the injunction could be used to shield the company from collections.

When attempting to implement the decision, CCEE raised questions about the significant change in Tradener‘s credit balance, which was classified as atypical.

The complexity deepened with the presentation of spreadsheets and data discrepancies, culminating in the widespread withholding of credits.

With the judicial reorganization process approved, Tradener used this new development to request the unblocking of its funds.

The court accepted the argument for credits subsequent to the approval date, but the discussion regarding prior amounts remains on the agenda at the Paraná State Court of Appeals, awaiting the merits judgment of the appeals.

Even with one of the parties withdrawing, the TJPR kept the case open due to the involvement of other creditors in the controversy.
