Aneel has rejected J&F‘s request to waive the prior financial guarantee for the Uruguaiana Thermoelectric Plant (UTE Uruguaiana), upholding the rules for advancing the energy transmission contract.
Brazil’s electric sector regulations faced a new test following a firm decision by the National Electric Energy Agency. The regulatory body chose to block the request filed by the J&F group, which sought to overturn the requirement to post a financial security deposit before finalizing the definitive energy outflow agreement for the thermoelectric plant located in the far south of the country.
The facility, with a substantial capacity of 639.9 MW and managed under the umbrella of Âmbar, currently operates under a provisional network usage agreement. However, the business group’s plans involved significantly accelerating the original operational schedule, aiming to bring forward electricity supply to late 2026.
Grid acceleration hurdles
To make the schedule change viable, the National Electric System Operator indicated the need to transition to the definitive infrastructure usage model. It was precisely at this point that the regulatory impasse formed, requiring the upfront financial contribution that the holding company attempted to bypass through administrative channels.
The company’s defense argued that the plant already has a consolidated history of commercial operation, which would render the safeguard mechanism unnecessary. Furthermore, representatives pointed out that the required procedure would generate unnecessary operating costs for a short-term document.
The regulator’s stance
Aneel‘s board maintained its technical rigor, emphasizing that making exceptions would compromise fairness among competitors in the free market.
The requirement of a prior guarantee is a pillar of security for accessing the transmission system, and an agent’s commercial urgency does not justify setting aside current rules that ensure fairness in the sector.
With the denial of the injunction, the business group will need to fully comply with the required procedures to consolidate the plant’s transition. The episode reinforces the strictness of regulatory bodies in enforcing the rules governing the national energy market.
