Court Suspends Oil Block Bidding in Sensitive Areas Following Arayara’s Lawsuit
A federal court decision marks a significant step forward in environmental protection in Brazil. A Public Civil Action filed by the International Arayara Institute has resulted in the suspension of bidding for 18 exploratory oil and gas blocks. The areas in question are located in environmentally sensitive regions within the Potiguar, Sergipe-Alagoas, and Espírito Santo basins, and the ruling reinforces the need for rigorous risk assessments before their inclusion in tenders.
The Institute presented technical evidence that the areas designated for exploration overlapped with or could interfere with conservation units, ecological corridors, quilombola territories, and habitats of endangered species. This action highlights the importance of oversight and civil society participation in defending Brazilian biodiversity.
Protection of Critical Areas and the Precautionary Principle
The 6th Federal Civil Court of the Federal District Judicial Section upheld Arayara’s arguments, ordering the National Agency of Petroleum (ANP), the Union, and the National Council for Energy Policy (CNPE) to refrain from holding new bidding rounds for the contested areas. The suspension will remain in effect until technical-environmental regularity is proven, with the approval of the competent authorities.
This measure is crucial as it prevents areas with known environmental risks from being offered without proper analysis. The decision reinforces the precautionary principle, ensuring that the planning of oil and gas exploration considers environmental preservation from the outset, rather than only in later stages of licensing.
Biodiversity Risks Averted
The judicial analysis recognized the environmental fragility of the affected regions. In the Potiguar Basin, the blocks were close to Private Natural Heritage Reserves (RPPNs). In Espírito Santo, interferences were identified in ecological corridors, conservation units, quilombola territories, and habitats of endangered species, such as the brown howler monkey and the leatherback sea turtle. In the Sergipe-Alagoas Basin, concerns focus on breeding areas for critically endangered species, such as the hawksbill sea turtle.
Juliano Bueno de Araujo, technical director of Arayara, celebrated the decision as a landmark in the protection of Brazilian biodiversity. He emphasized that the insistence on offering blocks without environmental and climate security exposes fragilities in the country’s oil and gas auctions.
