National Emergency Declaration Concerning Brazil Extended for Another Year

U.S. President Donald Trump has formalized the extension of the national emergency declaration involving Brazil for another year. This measure, published in the *Federal Register*, ensures the continuity of the diplomatic status established in July 2025. It is important to note that the act does not imply the imposition of new economic sanctions, nor does it alter import tariffs currently in force.

Understanding the Basis of the Decision

According to the official document issued by the White House, the decision to maintain the state of emergency is based on the U.S. administration’s assessment of the actions of the Brazilian government and deliberations by the Supreme Federal Court (STF). For the U.S., these events would pose threats to the country’s security and foreign policy. The justification details concerns related to issues such as human rights, freedom of expression, and the unfolding of legal proceedings involving former President Jair Bolsonaro and his allies.

Tariff Status and Legal Context

Although the legal status of the emergency has been renewed, the American government clarified that the measure does not reactivate the 40% commercial surcharge. This additional taxation had been applied in 2025 based on the International Emergency Economic Powers Act (IEEPA). However, the charge ceased to exist in February 2026, following a decision by the U.S. Supreme Court. The court understood that the Executive Branch does not have legal authority, through that specific law, to implement changes in import tariffs.
